Trade Promotion Terms and Conditions

IMPORTANT INFORMATION
You are required to carefully read and agree to these terms and conditions. To use the Platform you will also need to read the Generous Data Collection Guidelines & Policy and consent to our collection and processing of your personal information. The information in this box is to highlight certain legal aspects that are explained further below.   1. Definitions

    1. Cause means the specific charity or community cause to which Generous will distribute proceeds of fundraising.

    2. Content refers to content such as text, images, or other information that can be uploaded, linked to or otherwise made available or generated by you to Generous, regardless of the form of that content.

    3. Device means any device that can access the Platform such as a computer, a mobile phone or a digital tablet.

    4. Digital Product means a non-fungible token (NFT), digital collectible, or similar unique digital item (including a Giving Token) issued by or through Generous.

    5. Effective Date means the date that you register to use the Platform, consistent with The Generous Company Platform Terms and Conditions, and accept these Terms.

    6. Entrant means an individual purchaser of a Digital Product or the company, or other legal entity, on behalf of which, they are accessing or using the Platform, as applicable.

    7. Generous means The Generous Company Pty Ltd (ABN 29 679 992 164).

    8. Giving Circle means a group of Giving Token owners dedicated to giving to a Cause as designated from time to time by the Giving Circle.

    9. Giving Token means a type of Digital Product that records or signifies your participation in a Giving Circle or activity on the Platform.

    10. Law means, with reference to any applicable jurisdiction, any statute, regulation, bylaw or a provision of a statute, regulation, or bylaw and includes, without limitation, any statutory rule, or ruling by a statutory body.

    11. Platform means the website at www.generous.co and other websites, mobile sites, applications, blockchain-based systems, and other online services operated by Generous.

    12. Terms means these Trade Promotion Terms and Conditions regarding the use of the Platform.

    13. Third Party Services means any services or content (including data, information, applications and other products or services) provided by a third party that may be accessed via the Platform.

    14. Trade Promotion Prize means a prize available to Entrants on the Platform that is drawn Weekly.

  2. Promoter

    1. The promoter of the Trade Promotion described in these Terms and Conditions is Generous.

  3. Eligibility

    1. To participate, Entrants must have purchased a Giving Token and be members of a Giving Circle on the Platform.

    2. Each purchase on the Platform entitles the purchaser to one entry into the Trade Promotion Prize draw.

    3. Purchase of a Giving Token only makes an Entrant eligible for the next Trade Promotion Prize drawn, not for subsequent prize draws.

    4. Entrants must be over 18 years of age.

    5. Entrants must be Australian residents.

    6. Residents of South Australia are not eligible to enter.

    7. Employees of Generous, their immediate family members, and any associated agencies are ineligible to enter.

  4. Trade Promotion Prizes

    1. A Trade Promotion Prize is awarded each week to an Entrant.

    2. The prize amount is published each week in the Giving Circle for the duration of the Trade Promotion.

    3. The estimated total prize value for each Trade Promotion is $500. No Trade Promotion Prize value will exceed $3000.

  5. Entry Method

    1. To enter, Entrants must have purchased a Digital Product and be members of a Giving Circle for that week.

    2. Entrants are automatically entered into that week’s Trade Promotion Prize draw.

    3. No separate entry fee is payable. Participation is free with a valid Digital Token.

  6. Promotion Period

    1. For all Australian residents other than residents of the ACT, the promotion commences on 15 November 2025 and continues indefinitely unless otherwise terminated by the Promoter in accordance with regulatory requirements with not less than 30 days’ public notice.

    2. For residents of the ACT, the promotion commences on 15 November 2025 and ends on 14 November 2026 unless otherwise terminated by the Promoter in accordance with regulatory requirements with not less than 30 days’ public notice.

    3. Weekly prize draws will occur throughout the promotion period.

  7. Draw Details

    1. All draws are conducted weekly by Generous in a fair and transparent manner. Please see Schedule 1 for a list of draws to be conducted until 14 November 2026.

    2. Draws are conducted online at The Generous Company Pty Ltd, 5/7 Peel Street, Collingwood, Victoria 3066.

    3. Each weekly draw closes at 3:55 pm AEST Friday prior to the draw being conducted.

    4. Each week, an open source provably fair random generator is used to select a winning entry from all valid entries for the Trade Promotion Prize.

    5. The winner is notified within 48 hours.

    6. Each eligible entry has an equal chance of winning.

  8. Prize Amounts

    1. Cash prizes are published each week for the Trade Promotion Prize during the relevant week.

  9. Notification and Publication of Winners

    1. Winners will be notified directly via email or phone within 48 hours of the draw.

    2. Names of winners will be published on the Generous website (www.generous.co) indefinitely.

  10. Unclaimed Prizes

    1. All reasonable efforts will be made to contact winners.

    2. For residents of the ACT, if a prize remains unclaimed for three (3) months after notification, the Promoter will conduct a redraw on that day at 3:59pm at the same location.

    3. If a redraw is not required under state or territory regulations, the prize value will instead be donated to the Cause supported by the winner’s Giving Circle.

  11. Privacy

    1. Personal information collected is used for the purposes of conducting the promotion and as otherwise set out in the Generous Data Collection Guidelines & Policy.

    2. By entering, Entrants consent to this use of their information.

  12. Record Keeping

    1. Generous will retain promotion-related records in accordance with each State/Territory laws.

    2. Records will be managed in line with the Generous Data Storage Guidelines & Policy.

  13. General Conditions

    1. Entry and participation are subject to all applicable state and territory laws and trade promotion permit conditions.

    2. Generous reserves the right to cancel or amend the promotion only with regulatory approval where required.

    3. Prizes cannot be exchanged, transferred, or redeemed for other goods or services.

    4. Any unusual or onerous conditions will be clearly communicated in advertising material.

    5. This promotion is conducted as a free-entry trade promotion lottery. The purchase of a Digital Product including a Giving Token provides access to the Generous platform and does not involve any additional charge for entry into the prize draw.
